<description>&#60;p&#62;Hi I run a business centre and have recently supplied new IT hardware to one of my tenants - bought from my supplier and I have invoiced the tenant. He has asked if he can do an asset transfer of the equipment i.e. write them down of fhis books. He has suggested that he would issue me with a zero invoice and thate he would &#34;gift&#34; them to us. a) is this legal and b) is this the right way to do this assuming it is. Oh and a c) how would they show on my asset register? Thanks in anticipation of any help. Iain

&#60;p&#62;I live in the UK, am currently employed in UK by a UK company but have the option to work from home in the UK for a Spanish company, owned by friends of mine. &#60;/p&#62;
&#60;p&#62;They will be giving me a contract and a monthly salary but what I don't know or understand is what will happen regarding tax and NI contributions.&#60;br /&#62;
I know another option would be for me to work freelance and be responsible for paying my own tax and NI but for lots of reasons I feel safer on a contract of employment for now.&#60;/p&#62;
&#60;p&#62;Any advice would be gratefully recieved.&#60;br /&#62;

&#60;p&#62;I have spoken to a boss of a company where i worked previously. He has suggested setting up a branch office of his business with a slightly different name but under the same umbrella. I would be ensured a basic salary with a regular dividend payout. The parent company would obviously reap the benefits of having another 10 customers on its books as well as the prospect of more. &#60;/p&#62;
&#60;p&#62;My question is what should i look out for? What questions should i ask? Do you see any serious issues with what is being proposed?&#60;/p&#62;

&#60;p&#62;I hope to hear your views on one issue relating to accountancy side of the small business I run.&#60;/p&#62;
&#60;p&#62;The company operates under TOMS. We organize conferences for business clients from countries outside the EU, and most often get paid in Euro and USD. &#60;/p&#62;
&#60;p&#62;When issuing our invoices we set, as I understand it is, a commercial rate of exchange, which is around 10% greater than the rate on the day of issuing. &#60;/p&#62;
&#60;p&#62;For example, if the cost of all inclusive one week stay for one client is £3450, and current rate for Euro is 1.12 (which equals to 3864 Euro) – I would put the amount on the invoice 3864 x 1.1 = 4250 Euro. &#60;/p&#62;
&#60;p&#62;They have a choice, but majority of the clients make their payments either in Euro, or USD, as these are most commonly held currency accounts. Very few clients have accounts in British pounds.&#60;/p&#62;
&#60;p&#62;We add that 10% for the purpose not to lose on the currency fluctuations, as it may be a few weeks, or even months until the payment is received. As a relatively small business we can't afford any type of losses. &#60;/p&#62;
&#60;p&#62;The questions are:&#60;br /&#62;
1) What sales figure do we account for when doing our VAT returns? So far I've been accounting on £3450 sales figure, although the actual converted to GBP payment we receive is nearly always larger than £3450.&#60;br /&#62;
I could give a proof of accounting by this method by quoting from HMRC website (http://www.hmrc.gov.uk/vat/managing/international/foreign-currency.htm):&#60;br /&#62;
&#34;Advance invoices must therefore be in sterling for VAT purposes, and those sterling amounts will be what you'll have to enter into your VAT records. You can also show your invoice amounts in a foreign currency, but you'll have to make it clear that for VAT purposes, the value of the supply is the sterling figure, and is not a conversion of the foreign currency amount&#34;.&#60;/p&#62;
&#60;p&#62;2) Sometimes, the conversion of the foreign currency amount to sterling could come up to £500 larger than £3450. Is this treated as a gain on difference in exchange rates? Is it VATable?&#60;br /&#62;
Here I can say that on several occasions we actually incurred a loss to the original amount, although 10% seemed to be sufficient. &#60;/p&#62;
&#60;p&#62;3) As the pound hasn't been the most stable currency for the last several months, we set the price for one of our recent conferences in Euro. What will be the base value in GBP for VAT purposes?&#60;br /&#62;
I would probably not choose this base value to be the amount of Euro converted to GBP on the day of payment, if I had a choice. This would exclude the possible gain we could show as the gain on currency rate fluctuations.&#60;br /&#62;
Can it be the actual converted to GBP amount on the day of payment, minus 10%?&#60;br /&#62;
…minus 15% &#60;/p&#62;
&#60;p&#62;I would very much want to hear the view of professionals on the above.&#60;/p&#62;

<description>&#60;p&#62;I've had the same accountant for the last 5 years during which time I have paid them a Standing Order of £80 per month. They have had very little to do, I keep all my accounts on Quickbooks, enter all my expenses, reconcile etc. and only pay myself £4500 per year making up my monthly needs with money the company owes me, so no tax to pay. Due to the money owed to me the company has made a reducing loss each successive year, sales turnover is minimal, really not much to do at all. They say their charges reflect the 'work' they have to do in preparing and submitting my Income Tax return and my annual accounts but i've recently filed both in a matter of minutes. in all this time they never mentioned i could file abbreviated accounts online, i only found out when i spoke to another accountant. it seems a deliberate omission, what am i paying them for???  they contact me 2 or 3 times a year max so no additional advice at all. any views? if they don't refund seriously considering suing.

<description>&#60;p&#62;hi , I run a small ltd company and its the end of my first year , I gave the company a directors loan to get started and I was hopeing to get this loan back asap, &#60;/p&#62;
&#60;p&#62;my accountant has done my year end accounts and I have now to pay corporation tax on my profits , which would be fair , but I still have not had any repayment of my loan , which I consider a debt from the company to me and in my opinion it should be taken off before the profits are calculated as this is a debt/ expense which the business owes  me, if I bought a van with cash , it would be an expense , so I personally injected cash to the business to buy stock, van , training etc , why has my accountant not allowed me to get the money I am owed back before calculating the company profits  &#60;/p&#62;
&#60;p&#62;Can anybody help me as I dont see why the compnay is paying corporation tax whilst I am still owed my original loan ?

Over the last year I have put in £50k of my own money into my company. We are working on a software application and everything put in gets spent on development. We will be looking to raise funds after an year. &#60;/p&#62;
&#60;p&#62;Regarding the accounting of the £50,000, my accountant is suggesting I purchase shares worth £25,000 and show the remaining £25,000 as a loan from me to the company. Is there any logic to this? (Basically, why not issue shares for the entire amount to me?)

I have undergone an enquiry into my tax return &#38;#38; the inspector is disputing the fact that I have been deducting the 10% discount for wear &#38;#38; tear on the latter of the two properties. I contend that this property is not unfurnished &#38;#38; therefore it is permissable to apply the 10% deduction as the furniture which is in situ is experencing wear &#38;#38; tear. Is there any definitions within the legislation which define what is a furnished flat &#38;#38; is my deduction justified?
